Registering and defending your trademark

A name, a logo, a signature: your trademark is the asset your reputation accrues to. The firm secures it from clearance search to enforcement, in France and internationally.

Typical situations

  • You are choosing a name and want to make sure it is available before investing
  • Your application faces an opposition, or you need to file one
  • A competitor registers or uses a confusingly similar sign
  • You license or franchise your brand and need solid agreements

Clearance before commitment

The costliest mistake is building on a name you cannot keep. The firm runs availability searches — identical and similar signs, all relevant classes — and gives you a clear go, no-go or adjust.

Filing strategy

INPI, EUIPO, WIPO: the firm defines the classes, territories and timing that match your actual and projected business, and handles the filings and office actions.

Oppositions and disputes

Oppositions, cancellation actions, negotiated coexistence: the firm defends your sign before the offices and the courts, and negotiates when a deal serves you better than a decision.

Licensing and exploitation

Licences, franchises, distribution: agreements that protect the value of the sign — quality control, territories, term, exit.

Frequently asked questions

How long does trademark protection last?
Ten years, renewable indefinitely. Protection can nevertheless be lost through non-use over five years, or through degeneration — the firm sets up simple use-evidence practices to avoid this.
Should I file in France or at EU level?
It depends on your markets and your budget: a French filing is a solid start; an EU trademark covers all member states in a single title. The firm often sequences the two.
Someone filed my name before me — is it over?
Not necessarily. Bad-faith filings can be challenged, prior rights can be asserted, and negotiated buy-backs are common. Speed matters: contact the firm before contacting the filer.
